Possession & Enforcement
ActiveTexas maintains strict penalties for possession of most psychedelic substances. Psilocybin is classified as a Penalty Group 2 controlled substance. However, ketamine is available through licensed medical providers for off-label psychiatric use. The Texas legislature has funded a study on psilocybin for veterans with PTSD (HB 1802).
What's Allowed

- •FDA-approved clinical trials (limited availability)
Not Allowed
- •Psilocybin possession or use (felony offense)
- •MDMA possession or use outside clinical trials
- •Ayahuasca or ibogaine use
- •Any unlicensed psychedelic facilitation
